Public Notice

Notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to issue a modified Wyoming Air Quality Standards and Regulations (WAQSR) Chapter 6, Section 3 operating permit to the following applicant for the Colony Plant in Crook County, Wyoming:

Bentonite Performance Minerals, LLC

Belle Fourche, SD 57717

The Colony Plant is located in Section 11, Township 56 North, Range 61 West, Crook County, Wyoming (approximately 20 miles west of Belle Fourche, South Dakota, on Highway 212). The facility is a bentonite clay processing plant.

This permit is being modified to incorporate requirements of recently issued construction permits and authorization letters as well as a revised Compliance Assurance Monitoring plan and Quarterly Preventative Maintenance & Inspection logs. This modification reflects estimated decreases in yearly potential emissions of the following: 3 tons of particulate matter; 7 tons of PM10 particulate matter; 191 tons of SO2; 179 tons of NOx; and 0.8 tons of VOCs. This modification reflects an estimated increase in yearly potential emissions of 76.6 tons of CO. Only the modified portions of the permit are open for public comment.

These documents are also available online at the Division’s website (https://openair.wyo.gov), utilizing facility ID F000117 and permit number P0036103 under permits.

Public comments or a request for a hearing must be received no later than 5:00 p.m. local time (Mountain) on February 26, 2024. Requests for a hearing shall be in writing and shall include the name and contact information of the person requesting the hearing, a brief statement identifying the purpose of the request, and a brief statement of the issues to be discussed. Written public comments or requests for a hearing should be directed to the Administrator, Division of Air Quality, Department of Environmental Quality, 200 West 17th Street, Cheyenne, Wyoming 82002. Comments or requests submitted by email will not be included in the administrative record.
