The Town Council met this day in regular session at 7:00 p.m. with Acting Mayor Bradley Marchant presiding.

Roll call was taken by Acting Mayor Marchant with Council Members Joe Wilson, Callie Hilty and Randy Stevenson present.

Acting Mayor Marchant presented the City Council members with the recommended 2023 appointments: Brad Marchant-Acting Mayor in the absence of Mayor Brooks, Sundance Times-Official Newspaper, Theresa L. Curren-City Clerk Treasurer/Emergency Management Coordinator, Mac Erickson-Public Works Director/Zoning Code Official, Mark Hughes Law Office-City Attorney, Gari Gill-Fire Chief. COUNCIL MEMBER STEVENSON MOVED, COUNCEL MEMBER WILSON SECONDED, moved to approve the contract with Trihydro Work Order No. 23-001WO-E. All Ayes, MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to approve ORDINANCE NO 4, 2022 on the 3RD and final reading. AN ORDINANCE AMENDING ORDINANCE NO 2, 2013, PERTAINING TO OTHER USES PERMITTED IN THE INDUSTRIAL DISTRICT. All Ayes, MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER HILTY SECONDED a motion to table the Land Use and Planning meeting minutes of November 28, 2022 until next month. All Ayes, MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER HILTY SECONDED a motion to have City Attorney Hughes draft a letter to Jason and Darlene Coder reminding them of the terms of the agreement and to consider public safety and keep the sidewalk clear. All Ayes, MOTION CARRIED.

COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER WILSON SECONDED a motion to approve RESOLUTION 1, 2023 Official Depository, designating Sundance State Bank as the official depository for all City of Sundance Funds. All Ayes, MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to approve RESOLUTION 2, 2023 Adopting a Statement of Investment Policy. All Ayes, MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to approve RESOLUTION 3, 2023 Authorizing a SLIB Application through Water and Sewer ARPA for 3rd Street Waterline and Cleveland Street Project. All Ayes. MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER HILTY SECONDED a motion to approve RESOLUTION 4, 2023 Authorizing a SLIB Application of a Local Government ARPA for an addition to the city fire hall. All Ayes. MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to approve RESOLUTION 5, 2023 in Support of the Sundance Volunteer Fire Department for Grant Funding from the Wyoming State Forestry Division. All Ayes. MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER HILTY SECONDED a motion to allow the Mayor, Clerk, Deputy Clerk and the Acting Mayor to sign the Pledgee Agreement Form. All Ayes. MOTION CARRIED.

CLERK TREASURER THERESA CURREN asked that the Mayor, Council, Deputy Clerks and Department Heads sign Financial Disclosure Statements.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER WILSON SECONDED a motion to accept the new IRS mileage rate of $0.655 per mile. All Ayes. MOTION CARRIED.

COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER WILSON RECUSED HIMSELF, COUNCIL MEMBER HILTY SECONDED a motion to approve the Land Use and Planning minutes from December 20, 2022 as written. ACTING MAYOR MARCHANT STEPPED DOWN TO VOTE AYE. All Ayes. MOTION CARRIED.

COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER WILSON SECONDED a motion to table the discussion of utility rates for thirty days until we can accomplish a rate study and make a more informed decision. All Ayes. MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER WILSON SECONDED a motion to advertise the pastures up for bid for parcels one, two and three. All Ayes. MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to allow the mayor to sign the service agreement with Omega Computers. All Ayes. MOTION CARRIED.

Department Head Reports:

Fire Chief Gari Gill reported that they are working on several grants for the Volunteer Fire Department. One is a 50/50 grant to receive $15,000 for equipment. They will be putting in for the ARPA grant for a $535,000 addition to the fire hall. They currently have around $70,000 in donations and they are hoping to do in-kind work such as dirt work for the new addition. The other grant they are looking at is a First Responders Grant. The annual chili feed and fund raiser will be held on April 29th, 2023. Haven’t received many calls but have done some gas checks.

City Engineer Karla Greaser reported she is working with Public Works Director Mac Erickson on combining 3rd Street and Cleveland projects together to try for another ARPA grant. Provided a work order for the continuation of the contract between the City of Sundance and Trihydro.

Sheriff Jeff Hodge met with COUNCIL MEMBER WILSON on the City of Sundance Ordinances. Three ordinances will need updating. Department reported 88 calls for the month.

City Attorney Mark Hughes wanted to clarify that the paper stated an agreement was submitted to the Supreme Court, but that is not the case.

Discussion was made between City Attorney, Acting Mayor, Council and Sheriff Jeff Hodge about the best way to deal with city ordinances that are being broken; hire a city judge or utilize Circuit Court. City Attorney Mark Hughes will be meeting with Circuit Court Judge Bush on Friday, January 6, 2023 to discuss possibilities.

Trent Tope from Aladdin Water District asked the Acting Mayor and City Council if Public Works Director Mac Erickson can do Aladdin Water District’s water testing.
