Fred moved to approve the minutes from January 4 & 5, 2022. Jeanne seconded, all ayes, motion carried.

Jeanne moved to approve the following resolution:

RESOLUTION NO. 2022-6

FISCAL YEAR 2022 BUDGET AMENDMENT

WHEREAS Crook County adopted the Fiscal Year 2022 Budget in accordance with the Wyoming Uniform Fiscal Procedures Act; and

WHEREAS the Board of Crook County Commissioners wishes to amend the adopted budget in accordance with the same Act; and

WHEREAS, no protests were received regarding such transfer.

NOW, THEREFORE, BE IT RESOLVED that the following budget amendments are made.

• $77,344.98 to the Road & Bridge new equipment line from Unanticipated Revenues

• $7,080.84 to the Fire new equipment line from Unanticipated Revenues

• $668.88 to the Facilities new equipment line from Unanticipated Revenues

• $11,230 to Fire Fund Zone 12 line from Unanticipated Revenues

• $2,000 to Fire Fund Zone 25 line from Unanticipated Revenues

• $79,550.00 to Fire Fund general fund line from Unanticipated Revenues

After discussion, Fred moved to amend the following wording in Resolution 2022-4:

“WHEREAS County Road No. 108 known as the Rifle Pit Road is a county road that was established on November 14, 2014 at Commissioners Proceedings Book 3 at page 343 shown on Old Plat Map Number 165; and”

to read:

Jeanne moved for the Chairman to sign over a vehicle title on a 2005 Ford which will be given to Crook County Natural Resource District. Fred seconded, all ayes motion carried.

Jeanne moved to allow all bills as presented. Fred seconded, all ayes, motion carried. A complete, detailed listing of the monthly expenditures can be found on the county website. They can be found under the County Budget tab and are listed as “Monthly Accounts Payable/Payroll Payments”.

Fred moved to approve a Memorandum of Understanding Between Wyoming Department of Health, Public Health Division and Crook County for the COVID 19 Vaccination Outreach and for the County Clerk to use the Boards’ facsimile stamps if the grant document is not available before the meetings are over. Jeanne seconded, all ayes, motion carried.

Jeanne moved to transfer funds as follows: Pursuant to Wyoming Statute 16-4-112, notice is given that a Resolution has been proposed to transfer the following funds. Notice is further given that a hearing of the Board of Crook County Commissioners of Crook County, Wyoming will be held on March 1, 2022 at 8:30 o’clock a.m. to consider such proposed resolutions:

• $98,126.00 to Federal Grants-COVID 19 Vaccination Outreach-from Unanticipated Revenues

Fred seconded, all ayes, motion carried.

Per W.S. 16-9-104(c), Fred moved to reaffirm Resolution No. 1-2004 imposing a 911 Emergency Tax upon all telephone exchange access facilities within Crook County, authorizing service suppliers to collect the 911 Emergency Tax in order to establish, upgrade and operate an emergency telephone service system in Crook County,

Wyoming. Jeanne seconded, all ayes, motion carried.

Jeff Hodge, County Sheriff, Tammy Jundt, County Treasurer and Theresa Curren, County Assessor were present to go over items of interest within their departments.

Linda Fritz, County Clerk: Office recorded 467 documents, made 274 titles, working through all special district files to make sure all items have been sent to us per statute, doing a lot of cross-training in the office, staff is working hard to digitize the older receiving books so that we can take them to archives in Cheyenne, W2’s, 1099’s and 1095’s have been issued and sent out, Melissa and I will attend Clerks meeting in Cheyenne at the end of February, Clerk legislative committee reviewing and responding to proposed bills that effect elections. Linda & Melissa worked on the ARPA application with Joe and watched 2 presentations on ARPA funds.

Jeff Hodge, County Sheriff: Presented the monthly calls report, COVID is causing staffing issues, jail budget will be going over due to prisoner transports, requested that we look for some kind of jail medical policy as medical bills of prisoners could be very expensive for the County, the Flex/Cad system is now implemented-it was a very large project to get completed.

Tammy Jundt County Treasurer: Total receipts were $2,280,715.85 and disbursements to the county, county boards, towns and schools were $2,078,889.95. In January we did 3,197 transactions. We processed and mailed the 1099-INT for the CP redemptions in 2021. We’ve been busy at the counter and a lot of mail for motor vehicle renewals. We did one property tax CP redemption. We temporarily moved out of our office on January 6th to the Commissioner’s Room for the carpet installation and the painting of the walls. Started the move back to our office January 13th. We don’t quite have everything back but we’re close. I am working with the WYDOT and Sundance State Bank on setting us up to do a direct ACH instead of writing a check for our transmittal of fees to the state. I went to the Powder River IT Meeting last month. Met with the Assessor’s Office – Theresa and Tracey; and Rod Geil with Ron’s Contract Pumping regarding mobile machinery and personal property. Working with the techs from Tyler Technologies regarding the updating and teaching me how to use our programs to their full potential. Brenda is working on digitizing the records for the assessment roll for school districts. She is on the 1800’s.

Joe Baron, County Attorney; (Via email) Joe: New Cases: 30 Closed Cases: 53 Current Case Load: 118 In Court (January): 18 Lynda New Cases: 25 Closed Cases: 12 Current Case Load: 105 In Court (January): 33 We continue to hold court in person and by Video Conference with TEAMS, and both review multiple law enforcement investigations and cases. Joe dealt with the County civil matters. Have not heard back on the telephone bill issues. Reviewed the following Subdivision: Lofty Ridge Subdivision. Worked on bond reviews, legal advise for elected officials concerning duties. County Road matters--- Prepare Petition on CR 200 haul road, and find viewer to look into the petition to vacate a portion of County Road 21 and 807 (56) (Black and Yellow across Moskee). Public Road matters--- Worked on alteration of South Mountain Road and vacation of a portion of South Mountain Road. Worked on large lot subdivision rules. Special district matters ---Advised Clerk, Assessor, Treasurer and Commissioners about budgetary oversite of Special Districts and filing requirements of Special Districts with the County Clerk.

Prepared annual audit letter to Commissioners and County Auditors concerning potential county liability. Research COVID funds use, work on application process. Review BLM and Forest Service Land Use Plans. Complete County Compensation Policy. Complete County IT Gap Audit RFP and advertisement.

Theresa Curren, County Assessor: Mailed personal property and oil and gas renditions at the beginning of January.  Entering those into the CAMA system as we get them returned.  Commissioners received a letter from the Department of Revenue, showing that all in the Assessor’s office are certified Property Tax Appraisers.  Hoping to have all ownership transfers completed by the middle of February.  Veterans are able to sign for their exemptions from January through May. 

County Commissioners: Jeanne: Attended a timber meeting in Deadwood, attended a virtual “Outdoor Collaborative” meeting, met with the new Extension agent and showed him around Aladdin, met with Sheriff about ARPA and SLIB money, worked on broad band progress. Fred: Attended the fire board meeting, the Carlile water project meeting, took calls regarding roads and icy Courthouse sidewalks. Kelly: Drove most of the roads in the north and west of the county, volunteered many hours helping to catch up work at Weed & Pest, attended the Predatory Management District meeting and the Carlile water project meeting, took many phone calls.

The Board attended a virtual meeting on the upcoming Forest Revision Plans.

Mike Frey and Mike McGuckin, Moskee Land Corp were present to discuss their Petition to Vacate a Portion of County Road No. 21 Known as the Cold Springs County Road and a Portion of County Road No. 807 Known as the Lost Canyon County Road. Joe Baron, County Attorney, recommended appointing Floyd Canfield to be a viewer and appraiser. Mike Fry was opposed to the recommendation presented and requested that a County Commissioner be the viewer and appraiser. Joe recommended that a third party be appointed. There was discussion on who should be appointed. The Board will discuss this and possibly make a decision tomorrow.

The Board continued with the virtual meeting on the upcoming Forest Revision Plans.

Trey Hendrickson was present to discuss his Petition to Alter a Portion of Public Road Known as the South Mountain Road #281. Joe Baron, County Attorney, explained the petition to the Board. Jeanne moved to approve an Agreement to Cover Costs. Fred seconded, all ayes, motion carried. Fred moved to appoint Morgan Ellsbury to be a viewer and appraiser. Jeanne seconded, all ayes, motion carried.

Doug Leis, County Fire Warden, gave a monthly report. Ed Robinson, Homeland Security County Coordinator, gave a monthly report.

Pro River Technology gave a monthly update. Present were Jeff Hodge, Ed Robinson and Tammy Jundt.

Preston Beckstead, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.

Present to discuss the request to alter portions of the Little Missouri Road No. 200 were Otto and Jim Schlosser, Morgan Ellsbury (via Teams), Joe Baron, County Attorney and Ben Garman (via Teams). Otto and Jim presented a Petition to Alter a Portion of Road No. 200 known as the Little Missouri Road. After discussion, the Board agreed to make contact with affected land owners along the road to see if they are agreeable to the proposal presented by Schlossers.

Present to discuss the Petition to Vacate a Portion of County Road No. 21 Known as the Cold Springs County Road and a Portion of County Road No. 807 Known as the Lost Canyon County Road were Mike Frey, Mike McGuckin, Moskee Land Corporation, Morgan Ellsbury (via Teams) and Joe Baron, County Attorney. Mr. Frey expressed the purpose for the petition is to stop the trespassing on the property. Citations have been issued to various people who have trespassed onto the property and he considers it a safety hazard for his employee who lives on the property. The Board will appoint a viewer and appraiser in the next few months.

Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor gave monthly reports.

Fred moved to authorize the Road and Bridge Superintendent to impose and lift temporary weight limits on all county roads as weather and ground condition necessitate so as to cause the least amount of damage to the county roads, as authorized in Resolution No. 12-2007 Setting Size and Weight Limits on County Roads in Crook County, Wyoming. Jeanne seconded, all ayes, motion carried.

Fred moved to have Morgan Ellsbury, Road & Bridge Supervisor, accept the FRTA Easements from the USDA Forest Service for the Reynolds County Road No. 246 located in T50N, R61W, Sec 17 SW1/4SW1/4, Sec 20 S1/2SW1/4, Sec 29 N1/2NE1/4, NE1/4NW1/4; and the Clark County Road No. 247 located in T50N, R62W, Sec 11 NW1/4NE1/4 and Sec 12 SW1/4NW1/4 upon review and approval by the County Attorney. Jeanne seconded, all ayes, motion carried.

Present to discuss the progress made in creating a Compensation Policy for Crook County were Joe Baron, Tim Lyons, Jeff Hodge, Melissa Jones and Tammy Jundt. After discussion, Fred moved to appoint Todd Leimser, Melissa Jones, Tina Wood, Tammy Jundt and Morgan Ellsbury to the Salary Committee. Jeanne seconded, all ayes, motion carried. The next thing to be completed is the actual salary structure and submittal of job descriptions to the Salary Committee.

Representative Chip Neiman visited with the Board about upcoming legislation and asked if they had any concerns he could address.

Fred moved to approve the viewers and appraisers report submitted by Morgan Ellsbury on public road No. 281, known as the South Mountain Road. Jeanne seconded, all ayes, motion carried.

Bridget Helms, Office Manager, CCNRD, Troy Bifulco, VP of Information and Technology and Services , PreCorp, Jenna Ellsbury, Director, Crook County Senior Services, Wade Dennis, Member and Alycia Conroy, Office Manager, Weed & Pest District, and Tyler Lindholm, Statewide Policy Advisor/Field Representative for Senator Lummis, gave updates on items of interest within their departments.

Linda Fritz, County Clerk and Melissa Jones, Deputy County Clerk discussed the upcoming election for 2022 and key dates regarding election items:

• A new law is in effect. Reminder to all voters that you must present a photo id at the polls in order to vote.

• April 27th is the deadline to submit notice to the County Clerk for an August bond election. For example to put a tax levy proposition to the voters.

• May 17th- Last day for political party chairs to provide a list of potential election judges to the County Clerk.

• May 12th-27th is the filing period for candidates to be on the Primary ballot. This year those offices up for election are 2 Commissioner positions, Assessor, Attorney, Clerk, Clerk of the District Court, Coroner, Sheriff, Treasurer and precinct people. All districts/precincts are entitled to one precinct committeeman and one precinct committeewoman, except that District/Precinct 02-02 is entitled to 2 precinct committeemen and 2 precinct committeewomen per W.S. 22-4-101(b). The municipalities will be submitting their open positions to be placed on the ballot as well.

• June 9th - City Clerks to certify the list of candidates who applied for open municipal positions that will be on the ballot. Secretary of State also submits the candidates to be on the ballot.

• July 1st- ballots must be mailed to all military and overseas citizens by federal law. That is a relatively small window of time from June 9th in receiving the names to be put on the ballot to program the ballots, proof sample ballots and send the ballot order to the printers and receive them back for testing before July 1st.

• July 20th - is the deadline to submit notice to the County Clerk for a November bond election. For example to put a tax levy proposition to the voters.

• August 1st-Voter registration closes unless you are registering at the polls on Election Day or voting absentee at the County Clerk’s Office.

• August 9th-last day for candidates to file their campaign financing reports. There are monetary penalties if they are not filed in time.

• August 10-29th - Candidates file to be on the General Election ballot. This includes special districts and the school district.

• August 16th-Primary Election Day

• There are many more important dates for the General Election, but those can be discussed at a future meeting.

Joe Baron, Linda Fritz and Melissa Jones discussed statutes regarding special district reporting requirements and possibly having a mandatory training for trustees and reporting in person to the Board once yearly.

Present to discuss ARPA funds were Joe Baron, Jeff Hodge and Melissa Jones. After discussion, Jeanne moved to approve funding the E911 system upgrade for $516,405.00, as it will benefit all county residents and will also be required within 2 years and that we account for a 15% contingence for a possible increase in the cost since the quote was received. Fred seconded, all ayes, motion carried.

Fred moved to approve funding a communications tower with ARPA funds in the amount of $27,370.00 with a 15% contingence for a possible increase in cost since the quote was received. Jeanne seconded, all ayes, motion carried.

Jeanne moved to approve the following resolution:

RESOLUTION NO. 2022-7

TO COMMENCE PROCEEDINGS TO ALTER A PORTION OF A PUBLIC ROAD NO. 281, KNOWN AS THE SOUTH MOUNTAIN ROAD

WHEREAS a Petition was filed by Trey Hendrickson with the Board of County Commissioners to alter a portion of a public road, known as the South Mountain Road, recorded at Instrument No. 518315 located at Rod 22 Map 1220 (formerly File 311 Map 1220) upon the following described property, and more particularly described on the maps attached to the Petition, to-wit:

T.51N., R.62W. OF THE 6TH PRINCIPAL MERIDIAN, CROOK COUNTY, WYOMING

SECTION 19: LOT 4 (SW1/4SW1/4)

SECTION 30: LOT 1 (NW1/4NW1/4)

T.51N., R.63W. OF THE 6TH PRINCIPAL MERIDIAN, CROOK COUNTY, WYOMING

SECTION 24: SE1/4SE1/4

SECTION 25: NE1/4NE1/4

WHEREAS an agreement was entered into with Trey Hendrickson and Jeffrey Hare, to pay for the costs to commence proceedings to determine whether to alter a portion of said public road that are set forth in Road File No. 281; and

WHEREAS Equestrian Excursions LLC, Stuart Ranch Limited Partnership, 3YA LLC, Trey and Holly Hendrickson, the landowners affected by the alteration across their property have consented to the alteration; and

WHEREAS Wyoming Statute 24-3-101 (c) allows any public road to be altered in a manner provided by law for the alteration of highways and such laws are set forth at Wyoming Statute 24-3-101, et seq.; and

WHEREAS a viewer was appointed pursuant to Wyoming Statute 24-3-105 and 106 who filed a written report with the Board of County Commissioners recommending the proposed route be altered and damages considered.

THEREFORE BE IT RESOLVED that proceedings be commenced to determine whether or not to alter a portion of the public road, known as the South Mountain Road set forth above pursuant to Wyoming Statute 24-3-101, et seq.

Motion made, seconded and carried in an open meeting on February 2, 2022.
