8:30 o’clock a.m. Present were Chairman Kelly B. Dennis, Vice-Chairwoman Jeanne A. Whalen, Member Fred M. Devish and County Clerk Linda Fritz.

The Pledge of Allegiance was recited to the Flag.

Jeanne moved to appoint Kelly B. Dennis as Chairman of the Board of Crook County Commissioners and to appoint Jeanne as the Vice-Chairwoman of the Board of Crook County Commissioners. Fred seconded, all ayes, motion carried.

Jeanne moved to appoint Fred M. Devish as Crook County’s voting member of the Wyoming County Commissioner’s Association. Fred seconded, all ayes, motion carried.

Fred moved to appoint Fred M. Devish as the Crook County Volunteer Firefighters Association Advisory Board Member. Jeanne seconded, all ayes, motion carried.

Fred moved to appoint Kelly B. Dennis as the Crook County Employer Representative with Western Pathology Consultants, Inc. Jeanne seconded, all ayes, motion carried.

Fred moved to approve the minutes from December 7 and 8, 2021. Jeanne seconded, all ayes, motion carried.

Fred moved to approve the following resolution:

RESOLUTION NO. 2022-1

DESIGNATING THE OFFICIAL DEPOSITORIES FOR CROOK COUNTY FOR 2022

WHEREAS Wyoming Statute §9-4-816 through 9-4-831 governs the deposits and investments of county funds by Crook County; and

WHEREAS Resolution No. 8-1996 Statement of Investment Policy for Crook County allows investment of county funds while assuring the maximum safety of those funds: and

WHEREAS Wyoming Statute §9-4-817 (b) requires the County Treasurer to select the institutions designated by the Board of County Commissioners in and for Crook County, Wyoming pursuant to the restrictions stated therein and pursuant to law; and

WHEREAS the following financial institutions and State Treasurer should be designated as the official depositories for the public funds invested by Crook County as authorized by Wyoming Statute §9-4-831, namely: Sundance State Bank, Pinnacle Bank, Summit National Bank and any investment made available to the county through the State Treasurer of Wyoming, including the local investment pool, known as Wyo-Star authorized by W.S. 9-1-416 and the long-term investments pool, known as Wyo-Star II Wyoming Class authorized by W.S. 9-4-831 (a) (xxvii);

THEREFORE, be it resolved by the Board of County Commissioners in and for Crook County, Wyoming that the above stated depositories are designated as the official depositories of Crook County, Wyoming and that the County Treasurer, County Fair, Library and Weed and Pest Boards, other elected officers and departments are authorized to and shall only deposit and invest county funds in these depositories.

RESOLUTION NO. 2022-2

AUTHORIZING THE ACCEPTANCE OF NEGOTIABLE PAPER

IN PAYMENT OF FEES

WHEREAS Wyoming Statute §18-3-505 provides that the Board of County Commissioners may allow any county officer, agent or employee to accept negotiable paper including, but not limited to e-checks, credit and debit cards, electronic funds transfer in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit; and

WHEREAS any fees assessed for processing negotiable instruments, a credit card, other electronic funds payment or other payment shall be borne by the person tendering payment and any fees assessed for processing a credit card payment collected on behalf of the county and state shall be borne by the person tendering payment and not by the county and state; and

WHEREAS with respect to lender credit card and all other payment transactions the county is entitled to promptly present all negotiable paper to the bank upon which the negotiable paper is drawn for payment without any right of setoff or defense on the part of the issuer except as follows: Acceptance by the county of an expired card, Acceptance of a card for payment of an amount in excess of what the issuer authorized the county to accept, or Negotiable paper that is so improperly completed that the issuer cannot identify the card holder; and

WHEREAS any defense, claim or action that an individual using negotiable paper, a lender credit card and electronic funds transfers might have against issuers of the card shall not apply to the county, its officers, agents or employees or relieve the individual of responsibility for payment; and

WHEREAS the acceptance of negotiable paper or any other type of payment constitutes conditional payment for the amount owing. If the negotiable paper or any other type of payment is not dishonored the payment shall be effective on the date the paper was accepted by the county officer, agent or employee and receipted the same day, with the exception that the transaction could not be completed for a statutory reason. If the negotiable paper or any other type of payment is dishonored in the course of collection the conditional payment is of no effect and any receipt, certificate or license issued upon acceptance of the negotiable paper or any other type of payment is void. In the event any property including motor vehicle license plates is transferred or issued by the county or any of its officers, agents or employees upon acceptance of negotiable paper, and the paper is subsequently dishonored the county may rescind the transaction and a sheriff or other law enforcement officer may without prior court proceedings seize the property pursuant to W.S. 18-3-505(e). Neither the rescission nor seizure relieves the person presenting the negotiable paper from further civil or criminal liabilities as may be provided by law.

WHEREAS any negotiable paper including but not limited to e-checks, credit and debit cards, electronic funds transfer in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit, that is dishonored shall be collected in the following manner or a more restrictive if imposed by the officer or board:

1. Once the negotiable paper has been dishonored it shall be resubmitted once, and if still dishonored the officer, or employee within ten (10) days shall issue a written demand to make the payment.

2. Then if the payment remains unpaid the officer or employee shall rescind the transaction and deliver the dishonored negotiable paper to law enforcement for further action.

THEREFORE, be it resolved by the Board of County Commissioners in and for Crook County, Wyoming that:

1. Any county officer, agent or employee is allowed to accept negotiable paper including credit cards in payment of any tax, assessment, license, permit, fee, fine or other money owing to the county or collectable by the county on behalf of the state or other unit of government, or in payment of any bail deposit or trust deposit.

2. Any county officer, agent or employee who accepts negotiable paper is not personally liable, if the paper is dishonored and follows the collection process as required herein. Any losses arising from dishonored paper shall be allocated to the respective funds for which the negotiable paper was accepted.

3. In the event of losses from dishonored paper when the county or any of its officers are collecting funds for the state or any other level or unit of government, such losses shall be allocated to and accepted by the governmental entity for whom the collections were made;

3. Any payment made thereby is conditional as set forth in Wyoming Statute §18-3-505; and

4. Any fees assessed for processing a credit card payment, negotiable paper or other electronic funds transfers shall be borne by the person tendering payment.

FISCAL YEAR 2022 BUDGET AMENDMENT

WHEREAS Crook County adopted the Fiscal Year 2022 Budget in accordance with the Wyoming Uniform Fiscal Procedures Act; and

WHEREAS the Board of Crook County Commissioners wishes to amend the adopted budget in accordance with the same Act; and WHEREAS, no protests were received regarding such transfer.

NOW, THEREFORE, BE IT RESOLVED that the following budget amendments are made.

• $22,713.72 to Property Purchase-Firehall – From Emergency Reserves

• $41,674.69 to Deployed Firemen Expenses – From Unanticipated Revenues

Jeanne moved to approve a letter of support for Northern Wyoming Mental Health Center for the FY22 funding. Fred seconded, all ayes, motion carried.

After discussion, Fred moved to approve a letter to the State of Wyoming requesting funding for the Newcastle BLM Resource Management Plan Revision, a Service Agreement with Dru Consulting, LLC and a Memorandum of Understanding Between Crook County, Wyoming and The United States Department of the Interior (DOI) Bureau of Land Management (BLM) by and through the Wyoming BLM State Director Regarding Newcastle and Nebraska Resource Management Plan Revision and Environmental Impact Statement. The motion also included appointing Jeanne A. Whalen as the primary Representative and Dru Bower as the secondary Representative. Jeanne seconded, all ayes, motion carried.

Jeff Hodge, County Sheriff, Tammy Jundt, County Treasurer, Theresa Curren, County Assessor, Tina Wood, Clerk of District Court and Joe Baron, County Attorney were present to go over items of interest within their departments.

Linda Fritz, County Clerk: Office was business as usual, recorded 491 documents, made 286 titles, working on end of year duties, prepping for new year duties (W-2’s, etc), tracking proposed legislation, following the redistricting process-at this point Crook County is still remaining whole.

Jeff Hodge, County Sheriff: Presented the jail roster, getting lots of public records requests, meetings with legislators on a new SAPA bill, E911 may be federally mandated in the next couple of years, a deputy just graduated from the academy, working on the Game & Fish contract, working on the Flex system, got a new pick up in, replaced the engine on the Durango that had 190,000 miles to keep it in the fleet.

Mike Frolander, County Coroner: Mike updated the Board on the agreement to help Weston County coroner’s office. After discussion, Jeanne moved to approve the Memorandum of Understanding Between the Weston County Coroner and Crook County Coroner. Fred seconded, all ayes, motion carried.

Tina Wood, Clerk of District Court: Julie is out with knee replacement surgery, had a retirement party for Judge Perry, new Judge starts today, Judge Rumpke leaving in March, attended the basement remodel meeting, working on the salary policy with Joe.

Tammy Jundt, County Treasurer: Total receipts were $3,122,527.00 and disbursements to the county, county boards, towns and schools were $3,760,137.62. In December we did 3,319 transactions. Updated our bank accounts by adding Teresa Lang’s signature. Busy at the counter and had a lot of mail for December 31st tax payment deadline and motor vehicle renewals. We received the full payment from Ranch Oil Co for their 2021 taxes on December 22, 2021. We did three property tax CP redemptions. I have a full crew and it is very nice. We are packing stuff up to temporarily move to the Commissioner’s Office while they paint and install new carpet in our office. New desks have been ordered. Brenda is working on digitizing the assessment and tax roll records. She is on the 1980’s.

We continue to hold court in person and by Video Conference with TEAMS, and both review multiple law enforcement investigations and cases. Joe dealt with the County civil matters. Reviewed long distance telephone call issues and internet billing errors. Setting up a case management system in the office. Reviewed the following Subdivisions: Old Iron, Triple E, CLC No. 1, and Lofty Ridge Subdivision. Elected officials--- bond review, legal advice concerning duties, completed the MOU so the County Coroner can provide services and get paid for those services from the Weston County Coroner. County Road matters--- Prepared Resolutions establishing a portion of 160 (Wagner), establishing 108 (Rifle Pit) where it currently exists, and work on finding a viewer to look into the petition to vacate a portion of County Road 21 and 807 (56) (Black and Yellow across Moskee). Public Road matters--- alteration of South Mountain Road and vacation of a portion of South Mountain Road, advise that Beaver Creek Road is a County Road. Unable to work on large lot subdivision rules this month. Special district matters ---Advised Clerk regarding lack of notice or annual meeting and elections concerning the Predatory Animal Control Board that failed to advertise the meeting in the newspaper as required by law. Prepared annual audit letter to Commissioners and County Auditors concerning potential county liability. Research COVID funds use. Worked on application to Complete Opioid Settlement agreement with Attorney General Office. Review and complete Cooperative Agency MOU with BLM, County for upcoming BLM and Forest Service Land Use Plans; and review FNRPA for state funds to hire a contractor to assist the county; and review agreement between contractor. Prepare County Compensation Policy.

Theresa Curren, County Assessor: Printing Personal Property and Oil & Gas Renditions today.  Will try to mail by Thursday, January 6, 2022.  Theresa will be attending Wyoming Assessor Association meetings in Casper next week.  We have had a total of 883 deed transfers in 2021, which is over 200 from the year before.  Todd Fritz is retiring and will have his last day of work on April 30, 2022.  Would like to hire a replacement a month in advance to get them trained.  Also requesting hiring two full-time temporary employees for only the summer to help with the county sweep.

County Commissioners: Jeanne: Working on broadband in the Hulett area, went to a meeting in Deadwood regarding the Forest Service plan revision. Fred: Went to a meeting in Alzada ref: the haul road in that area, had email communications with staff and elected employees. Kelly: Communicated with Senator Driskill on redistricting and worked with some boards.

Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor gave monthly reports.

Present for the final hearing for Triple E Subdivision were Tim Lyons, Morgan Ellsbury, Callie Hilty, Cody Galloway and Robert Glenn. After discussion and with no objections being presented, Jeanne moved to approve the Order Approving One Split Subdivision and the One Split Subdivision Plat for Triple E Subdivision, contingent on all fees being paid and additional documents to be presented for recording. Fred seconded, all ayes, motion carried.

Present for the final hearing for CLC No. 1 Subdivision were Tim Lyons, Morgan Ellsbury, Cody Galloway, Callie Hilty, Robert Glenn, John Mallard & Ty Burrows. After discussion and with no objections being presented, Jeanne moved to approve the Order Approving Minor Subdivision and the Minor Subdivision Plat for CLC No. 1 Subdivision, Declaration of Covenants, Conditions and Restrictions for CLC No. 1, Crook County, Wyoming and Disclosure Statement for CLC No. 1 Subdivision, Crook County, Wyoming contingent on all fees being paid and all documents being signed by the subdivision grantor. Fred seconded, all ayes, motion carried.

Present for the final hearing for the Old Iron Subdivision were Tim Lyons, Morgan Ellsbury, Cody Galloway, Callie Hilty, Robert Glenn, John Mallard & Ty Burrows. After discussion and with no objections being presented, Fred moved to approve the Order Approving One Split Subdivision and the One Split Subdivision Plat for Old Iron Subdivision. Jeanne seconded, all ayes, motion carried.

Doug Leis, County Fire Warden, gave a monthly report. Ed Robinson, Homeland Security County Coordinator, gave a monthly update.

Present for the monthly IT update from Pro River were Tom Overstreet (Teams), Jeff Hodge and Tina Wood (per Teams).

Jeanne moved to transfer funds as follows: Pursuant to Wyoming Statute 16-4-112, notice is given that a Resolution has been proposed to transfer the following funds.

• $77,344.98 to the Road & Bridge new equipment line from Unanticipated Revenues

Morgan Ellsbury, Road and Bridge Superintendent and Larry Schommer, Facilities Maintenance Foreman, continued their monthly reports.

Jim and Otto Schlosser and Jay Pfar (via Teams) were present to discuss a proposal they have to improve and rebuild the haul road portion of Little Missouri County Road No. 200. They are requesting the county to obtain easements from the landowners and provide culverts, fencing, shale and gravel and they will pay all expenses for the improvements of the road for a 3.8-mile stretch.

REESTABLISHING COUNTY ROAD NO. 108 WHERE IT CURRENTLY EXISTS

WHEREAS County Road No. 108 known as the Rifle Pit Road is a county road that was established on November 14, 2014 at Commissioners Proceedings Book 3 at page 343 shown on Old Plat Map Number 165; and

WHEREAS County Road No. 108 has been altered several times over the last 107+ years with and without any formal proceedings, so the Board of County Commissioners determined that it was appropriate to resurvey the entire route of the road from where it starts near Beulah, Wyoming to where it ends between mile marker 12 and 13 on Old Highway 14 Frontage Road near Croell’s Gravel Pit; and

WHEREAS County Road No. 108 was resurveyed on a Map of Survey recorded at Instrument No. 656813, Rod No. 26 and map No. 1570 in the Crook County Clerk’s Office in Sundance, WY being sixty-six (66) feet wide right-of-way lying in and burdening the following described property, to wit:

WHEREAS all but one landowner provided easements for and consented to Crook County to establish the county road where it currently exists and they are recorded at Photo Book 631 at page 211 through 248 in the Crook County Clerk’s Office in Sundance, WY; and

WHEREAS Crook County obtained a FRTA Public Road Easement from the USDA Forest Service Black Hills National Forest recorded at Instrument No. 670842 Photo Book 624 at page 22 in the Crook County Clerk’s Office in Sundance, WY; and

WHEREAS, the Board of County Commissioners have the authority pursuant to Wyoming Statute 24-3-108 to establish a County Road by consent; and

WHEREAS the County will then identifying county roads in Township 52, North, Range 62 West of the 6th P.M., Township 52, North, Range 61 West of the 6th P.M., Township 53, North, Range 61 West of the 6th P.M., Township 53, North, Range 60 West of the 6th P.M., in accordance with W.S. 24-3-201 et seq.; and

WHEREAS, the Board of County Commissioners find that the establishment of the existing route for County Road No. 108 and vacation of all other unused and unmaintained routes is in the best interest of the County.

THEREFORE, BE IT RESOLVED that the Board of County Commissioners in and for the County of Crook, State of Wyoming, do hereby:

DECLARE THAT COUNTY ROAD NO. 108, NOW KNOWN AS THE RIFLE PIT COUNTY ROAD, from where it starts near Beulah, Wyoming to where it ends between mile marker 12 and 13 on Old Highway 14 Frontage Road near Croell’s Gravel Pit on the above described real property that was specifically described and show on Instrument No. 656813, Rod No. 26 and Map No. 1570 in the Crook County Clerk’s Office in Sundance, Wyoming IS HEREBY DECLARED AND ESTABLISHED AS A COUNTY ROAD, for use by the public, pursuant to W.S. 24-3-108; and

IT IS ORDERED that the County Clerk shall record this Resolution in the County Road Book and Highway Index, and abstract the Resolution in the land records pursuant to W.S. 24-3-118(d).

RESOLUTION NO. 2022-5

ESTABLISHING PORTION OF COUNTY ROAD NO. 160 WHERE IT CURRENTLY EXISTS AS A COUNTY ROAD ACROSS SCHOOL SECTION

WHEREAS County Road No. 160 originally known as the Poston Road and is now known as the Wagner County Road was established on December 29, 1922 at Commissioners Proceedings Book 4 at page 214; and

WHEREAS Crook County obtained Easement No. 231 from the State of Wyoming on September 3, 1926 that was recorded at Book 62 Page 246 in the Crook County Clerk’s Office for the location of where County Road No. 160 originally crossed a State School Section located at Section 36, Township 50, North, Range 66 West of the 6th P.M.; and

WHEREAS the County Road No. 160 has not existed in the original location set forth on State Easement No. 231 at least since Interstate 90 was built across County Road No. 160 in the 1960’s; and

WHEREAS the County has obtained a Perpetual Roadway Easement No. 9841 from the State of Wyoming that was recorded on December 2, 2021 at Instrument No. 674910, Photo Book 635 Page 663 in the Crook County Clerk’s Office across said school section where County Road No. 160 currently exists on the ground specifically describing the centerline of a 66 feet wide easement for the County Road No. 160; and

WHEREAS the County is in the process of identifying county roads in Township 50, North, Range 66 West of the 6th P.M in accordance with W.S. 24-3-201 et seq.; and

WHEREAS, the Board of County Commissioners have the authority pursuant to Wyoming Statute 24-3-108 to establish a County Road when in their judgment such action shall be in the interest of the economy or the public good and the road is of sufficient importance to be opened and traveled, and they so find; and

WHEREAS, this portion of County Road No. 160 affects the following property, to wit:

All of Section 36 in Township 50 North Range 66 West of the 6th P. M.

WHEREAS, the Board of County Commissioners find that this portion of County Road No. 160 road is of sufficient importance to remain opened, traveled. And established as a portion of County Road No. 160.

THEREFORE, BE IT RESOLVED that the Board of County Commissioners in and for the County of Crook, State of Wyoming, do hereby:

DECLARE THAT THE COUNTY ROAD NO. 160, NOW KNOWN AS THE WAGNER COUNTY ROAD, from Interstate 90 in a southwesterly direction to the southwest corner of Section 36 Township 50 North Range 66 West, that was specifically described and shown at Instrument No. 674910, Photo Book 635 Page 663 IS HEREBY DECLARED AND ESTABLISHED AS A COUNTY ROAD, for use by the public, pursuant to W.S. 24-3-108; and

IT IS ORDERED that the County Clerk shall record this Resolution in the County Road Book and Highway Index, and abstract the Resolution in the land records pursuant to W.S. 24-3-118 (d).

Jeanne moved to approve a long-distance calling plan with Range Telephone. Fred seconded, all ayes, motion carried.

Jeanne moved to approve a letter regarding the Request for Coordination and Cooperative Agency Agreement for the Black Hills Forest Service Plan Revision. Fred seconded, all ayes motion carried.

Fred moved to approve a letter of support for Crook County Natural Resources District in their efforts to obtain grant funding. Jeanne seconded, all ayes, motion carried.

Jeanne moved to transfer funds as follows: Pursuant to Wyoming Statute 16-4-112, notice is given that a Resolution has been proposed to transfer the following funds.

• $15,000.00 to the Resource Management Plan revisions-BLM & FS line from Unanticipated Revenues

Notice is further given that a hearing of the Board of Crook County Commissioners of Crook County, Wyoming will be held on February 1, 2022, at 8:30 o’clock a.m. to consider such proposed resolution.

Present for the discussion on the American Recovery Funds received were Morgan Ellsbury, Jeff Hodge, Larry Schommer, Joe Baron, Tina Wood (via Teams), Jamie Tarver, Alia Scott (via Teams), Bridge Helms, Tom Murphy and Arnie Altaffer. No decisions have been made at this time.

Fred moved to sign a letter written to Sundance State Bank authorizing that the County Extension Office be provided with a county credit card. Jeanne seconded, all ayes, motion carried.

Fred moved to sign a License for Use of County Road or Property to Crump Land & Livestock on Snooks County Rd. No. 133. After discussion, Kelly vacated the chair and seconded. Fred voted aye, Jeanne voted nay as they applied for the license after they already bored under the road, Kelly vacated the chair, voted aye, motion carried.

Jeanne moved to declare two vacancies for sportsmen on the Predatory Animal Control Board. Fred seconded, all ayes, motion carried. Anyone interested in the position can pick up an application at the County Clerk’s office or it is available on the county website.

The meeting adjourned at 3:20 o’clock p.m. to meet in regular session on February 1 & 2, 2022 at 8:30 o’clock a.m., in the Commissioner Room at the Courthouse in Sundance, Wyoming.
