COUNTY COMMISSIONERS

PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS AT THE COURTHOUSE IN SUNDANCE, CROOK COUNTY, WYOMING

10:00 o’clock a.m. Present for the special meeting were Chairman Kelly B. Dennis, Vice-Chairwoman Jeanne A. Whalen (per Teams), Member Fred M. Devish and County Clerk Linda Fritz. Also present in person were Jeff Hodge, Theresa Curren and Larry Schommer. Appearing by Teams were Joe Baron, Tina Wood, Tammy Jundt, Jodi Clark, Betty Lantis, Sarah Pridgeon, Tony Lantis and Morgan Ellsbury.

Per W.S. 18-3-903(b) and after discussion, Fred moved to appoint Tammy Jundt as the temporary Treasurer and to prorate her current wages as of September 17, 2021 to the current Treasurer wages as she is now performing those duties. Those wages will be in place until the conclusion of the temporary appointment. Jeanne seconded, all ayes, motion carried.

After discussion, Fred moved to approve the following resolution and for the County Clerk to use Jeanne’s facsimile stamp on the resolution:

RESOLUTION 2021- 15

APPOINTING TEMPORARY COUNTY TREASURER

WHEREAS on July 26, 2021 in accordance with Wyoming State Statute 18-3-902 the Board of County Commissioners in and for Crook County, Wyoming requested that the Governor of Wyoming direct the Attorney General to commence and prosecute an action in the district court of Crook County asking for the removal of the Crook County Treasurer for being guilty of misconduct or malfeasance in office;

WHEREAS the Board of County Commissioners requested that the Governor of Wyoming issue an order suspending the Crook County Treasurer from the further exercise of her duties until the termination of the trial of such officer as provided by W.S. 18-3-903 so the Board of County Commissioners may appoint someone to temporarily fill the office and perform the duties thereof;

WHEREAS on September 16, 2021 the Governor has issued a Governor’s Order for Temporary Suspension of Crook County Treasurer;

WHEREAS Wyoming State Statute 18-3-903(b) requires the Board of County Commissioners to appoint a qualified elector to temporarily fill the office of and perform the duties of the County Treasurer so long as the suspension continues in accordance with Wyoming Statute 18-3-903(b);

WHEREAS it is in the best interest of the county and its’ citizens to temporarily appoint Tammy Jundt.

THEREFORE BE IT RESOLVED by the Board of County Commissioners in and for Crook County, Wyoming to appoint Tammy Jundt who is a qualified elector to temporarily fill the office of and perform the duties of the Crook County Treasurer so long as the suspension continues in accordance with Wyoming Statute 18-3-903.

Motion made, seconded and carried in an open meeting on September 17, 2021.

After discussion was held on the wage for Mary Kuhl, Fred moved to continue to pay Mary Kuhl her regular monthly wage through the time that the proceedings in W.S. 18-3-903 are taking place. Jeanne seconded, all ayes, motion carried.

The meeting adjourned at 10:29 o’clock a.m. to meet in regular session on October 5 & 6, 2021 at 8:30 o’clock a.m., in the Commissioner Room at the Courthouse in Sundance, Wyoming.
