The Town Council met this day in regular session at 7:00 p.m. with Mayor Paul Brooks presiding.

Roll call was taken by Mayor Paul Brooks with Council Members Joe Wilson, Brad Marchant, Callie Hilty present. Council Member Randy Stevenson was excused.

Approve Minutes of the City Council Regular Meeting of January 3, 2023, as published. Approve the January adjustment report. Approve the January Paid Invoice report. Approve the February Unpaid Invoice Report. MOTION CARRIED (per consent agenda).

COUNCIL MEMBER WILSON MOVED, COUNCEL MEMBER MARCHANT SECONDED, moved to approve the contract with Trihydro Work Order No. 23-003WO-E. All Ayes, MOTION CARRIED.

Public Works Director Mac Erickson and City Attorney Mark Hughes will work together to look into the history of the Tenke Mobile Home Court and the two separate houses to see if some of the agreements have expired.

Discussion was made if variances carry over for new land owners and time constraints. The agreement with another council becomes null and void and there is severability when the real estate changes hands.

The January 30, 2023 permit application was denied and a new building permit needs to be updated along with a new map with correct setbacks and brought before the Land Use & Planning Board.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER WILSON SECONDED a motion to approve the Land Use and Planning meeting minutes of January 30, 2023. All Ayes, MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER HILTY SECONDED a motion to have City Attorney Hughes draft a letter for the council to Jason and Darlene Coder for violation of the city ordinances. All Ayes, MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion for the 2023 rates to increase 4%. COUNCIL MEMBER MARCHANT made a FRIENDLY AMENDMENT to increase the utility deposit to $150 from $100. COUNCIL MEMBER WILSON SECONDED. All Ayes. FRIENDLY AMENDMENT CARRIED. All Ayes. MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion to approve Resolution 6, 2023 supporting Old Stoney Restoration Project Phase II. All Ayes, MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion to allow Mayor Brooks to sign the audit with Leo Riley and Company. All Ayes, MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER WILSON SECONDED a motion to repurchase the remaining lots back from Betty Reynolds. All Ayes. MOTION CARRIED.

MAYOR PAUL BROOKS swore in Carolyn Fowler for the Economic Development Board.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER WILSON SECONDED a motion to approve Dime Horseshoe Bar, Sundance High School and The Turf’s 24 Hour Permits for Winterfest. All Ayes. MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion for Mayor Brooks to sign the Chapter 56 agreement between the City of Sundance and the Wyoming Game & Fish. All Ayes. MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to offer Shad Schloredt the same contract that was made with Nick Kiminski. COUNCIL MEMBER HILTY made a FRIENDLY AMENDMENT to alter the contract to change the amount of deer up to 100. COUNCIL MEMBER WILSON SECONDED. All Ayes. MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to fund Fire Chief Gari Gill’s trip to Cheyenne for the SLIB meeting. All Ayes. MOTION CARRIED.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion for City Attorney Mark Hughes to pursue talking to attorney Mark Macy to speak to the lawyer on Sand Creek into being Municipal Judge. All Ayes. MOTION CARRIED.

Paul Stilles, CPA, of the firm Leo Riley & Company, went through the Audit DRAFT that he wrote up for the City of Sundance for the fiscal year 2021-2022.

Nate Holst of the Wyoming Game & Fish brought up the fall Chapter 56 contract that filled the quota of 50 deer. 7 out of the 50 deer tested positive for the Chronic Wasting Disease. This amounts to 14% of the heard having the disease, which surpasses the 7% found in other herds everywhere else. The Wyoming Game & Fish would like the City of Sundance to fill out another Chapter 56 application and this time kill up to 100 deer. This application would continue currently through the year until 100 deer are killed.

Tony Barton discussed Winterfest.

Mike Bayne discussed wanting to tap onto the city water on Government Valley Road. Mayor Brooks asked City Attorney Mark Hughes and Public Works Director Mac Erickson to work together to do research for March’s city council meeting.

Department Head Reports:

Crook County Sheriff Deputy Jory Tadlock reported the call list and that deputies will be available around for the Winterfest on February 18th.

Fire Chief Gari Gill reported that he is trying for the AFG grant in order to purchase 15 new airpacks. This grant will need a 5% match. He would like to attend the SLIB meeting for the ARPA grant that was turned in for the Volunteer Fire Department on February 27th and 28th. The Sundance Volunteer Fire Department currently has 23 firefighters. They are young and mostly all certified. Fire Chief Gill attended a Leadership and Retention class in Riverton. They also have a $10,000 credit with J&M Enterprises to order equipment to fulfill the VFA grant. The annual chili feed and fund raiser will be held on April 29th, 2023.

Public Works Director Mac Erickson will be attending the SLIB meeting on February 27th and 28th for the 3rd Street and Cleveland project.

Economic Development Chairman Jeremy Holt reported that they started meetings again in January and elected new officers. Their road map is to concentrate on housing. Next meeting is February 27th and their first speaker is Kathy Lenz, who will talk to the board to learn what grants are available for housing.

City Clerk-Treasurer Theresa Curren reported that pasture bids are due March 1st. Starting Liquor License renewal for 2023-2024 and the hearing will be in May. Renewing our entity for Sams.gov in order to receive grant funds. Contacted Civic Plus and are carrying through with the city’s codification.

City Attorney Mark Hughes reported that he spoke to Judge Bush and her staff about Municipal Court and Circuit Court. City Attorney Hughes recommends getting a city judge like Pine Haven. The city has notes with high rates and he recommends that we pay down the loans with city CDs.
