Probation revoked for Gillette man sentenced on drug charges

Gillette resident Milford Hiebert has been sentenced to up to five years in a state penal institution after his probation was revoked for failing to complete a court-ordered rehabilitation program.

Hiebert was serving three years of supervised probation for possession of a controlled substance, third or subsequent offense.

According to the complaint, Hiebert violated the condition of his probation order that he enter and successfully complete the program at the Volunteers of America Adult Community Corrections Facility in Gillette, remaining there as a resident until he completes the program.

The complaint states that Hiebert was removed from the program for rules violations.

Hiebert received a suspended sentence in March, 2021 after evidence of marijuana use was found in his vehicle during a traffic stop for speeding.

In April, 2020, a Wyoming Highway Patrol trooper pulled Hiebert’s vehicle over and approached the driver. While completing a check of the VIN number, the trooper allegedly noticed the odor of burnt marijuana.

According to court reports, a search revealed an electronic smoking device that smelled strongly of burnt marijuana and, in the trunk, a “heavily used” glass smoking pipe containing suspected burnt marijuana and, under the trunk floor, a dispensary bottle containing suspected raw marijuana residue.

Due to his criminal history, he was placed under arrest.

Hiebert pled guilty to one felony count of possession of a controlled substance, third or subsequent offense and was sentenced to between three and five years in jail and a $5000 fine. This sentence was suspended pending successful completion of three years of supervised probation.

Due to the probation violation, Judge James Michael Causey has reinstated the sentence of up to five years, with credit for 422 days served and a recommendation that Hiebert be placed in a Youthful Offender Transition Program.
