Nevada resident Eddy Prieto-Madril was given a suspended sentence in Crook County District Court for his fifth offense of driving under the influence. A week later, a date was set for a hearing to revoke his probation after he allegedly failed to comply with its terms.
On August 28, 2019, at around 12:45 p.m., a Wyoming Highway Patrol trooper observed a vehicle traveling above the speed limit near milepost 202 on I-90. He confirmed the speed to be 88 mph in an 80 mph zone and reports “finally” conducting a stop at around milepost 199.
“When I activated my emergency lights, the vehicle drifted over the center line,” reports the trooper in his affidavit. “The driver also took a while to pull over and I could see him moving around inside the vehicle as he was coming to a stop.”
Prieto-Madril was identified via his Nevada identification card and allegedly admitted to having a suspended driver’s license. The trooper allegedly spotted an open beer bottle tucked between the center console and a case of beer.
According to court reports, Prieto-Madril stated he had drunk three beers. Due to this admission and “the overwhelming odor of an alcoholic beverage” from inside the vehicle, the trooper performed standardized sobriety tests.
Prior to beginning the tests, Prieto-Madril allegedly admitted to having drunk five beers, starting in North Dakota. Based on his performance on the tests, he was placed under arrest.
After allegedly refusing the breath test, Prieto-Madril was taking to Crook County Memorial Hospital, where his blood was drawn. A review of his criminal history revealed two prior DUIs in Nevada and two in North Dakota within the last ten years.
Prieto-Madril pled guilty to a felony charge of driving while under the influence, fifth offense. He was given a suspended sentence of between 30 and 66 months in a state penal institution and a fine of $10,000, half of which was to be suspended, pending completion of five years of completion.
This sentence was imposed on June 30. A week later, a petition to revoke his probation and criminal warrant were filed with the claim that he violated the terms and conditions of that probation by failing to report to the Crook County Probation Agent.
